Please find below the amendments to the Electronic Banking Conditions of Use for ANZ Mobile Phone Banking. You accept these amendments to the Electronic Banking Conditions of Use upon your activation of ANZ Mobile Phone Banking.
Amendments to the Electronic Banking Conditions of Use for ANZ Mobile Phone Banking
- In the section headed "Definitions" after the definition for "CRN" the following definition is inserted:
"'ANZ Mobile Phone Banking' means M-Banking and TXT-Banking".
- In the section headed "Definitions" the following definition is inserted as the first item in the definitions list:
"'Activation Code'" means the 7-digit temporary activation number issued to activate the M-Banking or TXT Banking service."
- The definition of "Telecode" is amended to include the following words after the words "ANZ Phone Banking":
"and your ANZ Mobile Phone Banking Activation Code"

The following paragraph is inserted after the paragraph headed "How you can use ANZ Internet Banking":
"Fees and Charges for ANZ Mobile Phone Banking"
Fees and charges may apply to ANZ Mobile Phone Banking and customers will be advised of these at the time of applying for the service or prior to the fee being charged.
You may also incur charges from your mobile phone operator as a result of using ANZ Mobile Phone Banking. Any such charges are solely your responsibility."
- The following words are inserted after the words "When applying for Pay Anyone" in the first sentence under the heading "Access to and use of Pay Anyone and International Services", "(a) Obtaining Pay Anyone":
"for Internet Banking"
- The following sentence is inserted at the end of the first paragraph under the heading "Access to and use of Pay Anyone and International Services", "(a) Obtaining Pay Anyone":
"When applying for Pay Anyone for ANZ Mobile Phone Banking, your daily limit will be as advised to you by ANZ and may not be changed by you."
- The following words are inserted after the words "Pay Anyone" in the first line of the second paragraph under the heading "Access to and use of Pay Anyone and International Services", "(a) Obtaining Pay Anyone" and after the word "limit" the first time it appears in the second paragraph under the heading "Access to and use of Pay Anyone and International Services", "(a) Obtaining Pay Anyone":
"for Internet Banking"
- The following words are inserted after the word "limit" in the fourth paragraph under the heading "Access to and use of Pay Anyone and International Services", "(a) Obtaining Pay Anyone":

- The following sentence is inserted at the end of the first paragraph under the heading "Access to and use of Pay Anyone and International Services", "(b) Obtaining International Services":
"International Services are not available through ANZ Mobile Phone Banking."
- The heading "Access levels for ANZ Phone Banking and ANZ Internet Banking" is amended to read "Access levels for ANZ Phone Banking, ANZ Internet Banking and ANZ Mobile Phone Banking".
- The following words are inserted at the end of the second last paragraph under the heading "Access levels for ANZ Phone Banking, ANZ Internet Banking and ANZ Mobile Phone Banking", "Access Levels":
"and ANZ Mobile Phone Banking to change their own password."
- The following words are inserted after the fifth paragraph under the heading "Processing instructions - general":
"ANZ may notify you of electronic transactions (instructions for which are received through ANZ Mobile Phone Banking) it is unable to process."
- The following words are inserted as the fourth bullet point at the end of the sixth paragraph under the heading "Processing instructions - general":
"future dated transfers are not available through ANZ Mobile Phone Banking."
- The heading "Processing Instructions - ANZ Phone Banking and ANZ Internet Banking" is amended to read "Processing Instructions ANZ Phone Banking, ANZ Internet Banking and ANZ Mobile Phone Banking".
- The words "ANZ Phone Banking or ANZ Internet Banking" in the first and second paragraphs under the heading "Processing Instructions - ANZ Phone Banking, ANZ Internet Banking and ANZ Mobile Phone Banking" are amended to read "ANZ Phone Banking, ANZ Internet Banking and ANZ Mobile Phone Banking".
- The following paragraph is inserted before the heading "Card Validity":
"Short Message Service (SMS)
You agree that, by registering for ANZ Mobile Phone Banking, ANZ may send SMS to your nominated mobile phone. ANZ is not liable for any loss or damage you suffer as a result of any person other than you accessing those SMS."
- The following words are inserted after the word "inactive" in the sixth bullet point under the heading "Withdrawal of Electronic Access":
"or the account you have nominated for ANZ Mobile Phone Banking fees and charges to be charged to is closed"
- The following words are inserted as the sixth bullet point under the heading "When the account holder is liable":
"by failing to secure your mobile phone or leaving your mobile phone logged into ANZ Mobile Phone Banking".
- The following words are inserted after the word "equipment" in the second paragraph under the heading "Equipment Malfunction":
"including your mobile phone with respect to ANZ Mobile Phone Banking"
- The following words are inserted after the words "PC anti - virus and" or "personal computer anti - virus and" in the third paragraph under the heading "Equipment Malfunction":
