1. Introduction

These are the current ANZ eBiz Terms and Conditions setting out your rights and obligations involving the use of ANZ eBiz, including the use of ANZ eBiz to make a BillPay payment and use of Pay Anyone.

It is important that you read these ANZ eBiz Terms and Conditions before you use ANZ eBiz. This way you will understand the proper use of ANZ eBiz.

If you do not understand, or are unsure about any aspect of the ANZ eBiz Terms and Conditions, do not hesitate to ask ANZ to clarify the matter for you.

Definitions

The following definitions apply throughout this document unless otherwise stated:

What is ANZ eBiz?

ANZ eBiz is a banking system that you can access yourself via the Internet (www.anz.com). The self-explanatory screens in the ANZ eBiz system will guide you in selecting different options to conduct your routine banking transactions.

What is BillPay?

This is an electronic payments scheme whereby you can ask ANZ via the ANZ eBiz facility to make payments on your behalf to billers (such as certain utility companies) who are members of the BillPay Scheme.

What is Pay Anyone?

This is a service, which you can register for via ANZ eBiz to make transfers from your local currency accounts to third parties. Cross-currency payments are not available.

To Whom do these ANZ eBiz Terms and Conditions Apply?

These ANZ eBiz Terms and Conditions apply to the use of ANZ eBiz by you where you have nominated to access and use a business account via ANZ eBiz. This includes the use of ANZ eBiz to make payments via BillPay and Pay Anyone.

They operate in conjunction with the terms and conditions applicable to the account(s), which you have nominated to be accessed by use of ANZ eBiz. Unless otherwise specifically stated to the contrary, to the extent that there is any inconsistency between these ANZ eBiz Terms and Conditions and the separate terms and conditions for an account, these ANZ eBiz Terms and Conditions will apply.

When do these ANZ eBiz Terms and Conditions take effect?

If you have not previously agreed in writing to accept these ANZ eBiz Terms and Conditions, the first use of any ANZ eBiz service will constitute your and your authorised agent’s acceptance of these ANZ eBiz Terms and Conditions.

2. Authorised agents

Nomination

A third party can be nominated to be an authorised agent in respect of an account. If a person is nominated as an authorised agent, such person may be given either "value" or "non value" access (as described in clause ‘Access’).

The account holder acknowledges that:

Responsibility for authorised agents

The account holder is responsible for any use of ANZ eBiz by an authorised agent within the access level nominated for them, including all transactions performed through ANZ eBiz by any authorised agent who has value access on the account(s), as if that use were by the account holder. The account holder is also responsible for ensuring that each authorised agent complies with all obligations and responsibilities imposed on the account holder under these ANZ eBiz Terms and Conditions.

Changing levels of access or revoking authority

The account holder may request that ANZ cancel, or change the level of access of, an authorised agent at any time and may alter the nominated multiple authorisation level by completing the relevant ANZ eBiz form for cancellation.

3. How do I initially access eBiz?

You can access ANZ eBiz using the CRN and password provided to you by ANZ. This will allow access to all account(s) the account holder has nominated to be accessed via ANZ eBiz by you.

When you first use ANZ eBiz, you will be required to change the ANZ issued password and select a new 8 character password (consisting of alpha and numbers) as the new password.

Separate passwords and CRN’s are required for each officer of the account holder’s business who is authorised to access ANZ eBiz. It is the responsibility of the account holder via the principals of the business to decide which officers of the business will have access to ANZ eBiz and what level of access such officers will have (please see clause ‘Access’). An officer of the business who is authorised in writing by the principals of the business to have access to the service is known as an authorised agent. ANZ will issue CRN’s and temporary passwords to each authorised agent.

When an authorised agent leaves your business the CRN and password of that Authorised Agent must be cancelled. Those person(s) authorised to transact on the relevant account can cancel any CRN and password associated with that account at any time by calling the Call Centre.

4. Access to ANZ eBiz

Access subject to these ANZ eBiz Terms and Conditions

ANZ agrees to make available to you access to ANZ eBiz in accordance with, and subject to these ANZ eBiz Terms and Conditions.

ANZ may, at any time and without notice to you, add or remove or make changes to any ANZ eBiz service.

Interruption to ANZ eBiz

ANZ does not represent or guarantee that access to ANZ eBiz will be uninterrupted. You acknowledge that ANZ eBiz may be affected by outages, faults or delays. Such outages, faults or delays may be caused by factors including, but not limited to, technical difficulties with the performance or operation of ANZ's or another person's software, equipment or systems, traffic or technical difficulties with the internet, or infrastructure failures such as damaged phone lines or interference with digital signals.
