  1. These terms and conditions ("Terms") apply to ANZ MoneyManager.
  2. Yodlee, Inc. of 3600 Bridge Parkway, Redwood City, California 94065 (the "service provider") provides ANZ with the technology and other services required to deliver ANZ Money Manager. The service provider is a third party beneficiary under these Terms with all the rights, benefits and protections as if it were a party to these Terms and a reference to ANZ in these Terms shall (for the purpose of the service provider receiving the full benefit of such rights, benefits and protections) also be deemed to be a reference to the service provider.
  3. ANZ MoneyManager is an information management service that allows you to consolidate and view information relating to your ANZ accounts and your accounts held with a third party from its website ("Third Party Website").
  4. When you use ANZ MoneyManager to access a Third Party Website you:
    • authorise ANZ to use information provided by you to access a Third Party Website; retrieve information requested by you (including information concerning individuals and other entities you have set up to receive payments from you ("Payees") and payments you have made to Payees); to copy or transfer such Payee and payment information; to register to view the accounts requested by you and to otherwise use, modify, display, distribute and create derivative works from such information to provide ANZ MoneyManager to you. For these purposes you appoint ANZ and its service provider as your agent with the full power to do and perform each act or thing requisite and necessary to be done and as fully as you might or could do in person;
    • represent that you are the legal owner of the account at the Third Party Website and that you have the authority to designate ANZ and its service provider as your agent and to give us the information you provide to use ANZ MoneyManager;
    • acknowledge that when ANZ and its service provider accesses and retrieves information from a Third Party Website they do so as your agent and they are not the agent of the entity providing the Third Party Website; and
    • acknowledge that balances shown on ANZ MoneyManager obtained from a Third Party Website reflect the most recent refresh by the entity providing the Third Party Website and the most recent refresh by ANZ MoneyManager and may not be as accurate as if the Third Party Website was accessed directly.
  5. ANZ has no responsibility for any transactions, inquiries or other activities you initiate at a Third Party Website, the products and services at a Third Party Website and any fees charged by the entity providing the Third Party Website.
  6. You represent that all information you provide to ANZ and its service provider in connection with ANZ MoneyManager is accurate, current and complete, and that you have the right to provide such information to ANZ and its service provider for the purpose of operating ANZ MoneyManager. You agree to not misrepresent your identity or your account information. You agree to keep your registration and account information up to date and accurate.
  7. You are responsible for maintaining the confidentiality of your personal identification number ("PIN") and other log-in information in relation to ANZ MoneyManager and any Third Party Website. You must not:
    • disclose your PIN and other log-in information to any other person, except to the extent necessary for ANZ to provide ANZ MoneyManager to you;
    • keep a record of your PIN and other log-in information;
    • write your PIN down and other log-in information;
    • negligently or recklessly disclose your PIN and other log-in information by, for example, failing to take reasonable care when typing it or keying it in
    The PIN and other log-in information that you select must not be easily identifiable or based on easily accessible personal data.
  8. You are permitted to use content delivered to you through ANZ MoneyManager only on ANZ MoneyManager. You may not copy, reproduce, distribute, or create derivative works from this content or reverse-engineer any part of ANZ MoneyManager.
  9. Except to the extent prohibited by law, regulation or code of practice or conduct (including the ePayments Code or the Code of Banking Practice), you agree to protect and fully compensate ANZ and its service provider from any and all third party claims, liability, damages, expenses and costs (including, but not limited to, indirect, incidental, consequential loss and damage) caused by or arising from your use or the inability to use ANZ MoneyManager; your violation of these Terms; unauthorised access to or alteration of your transmissions or data; your infringement, or infringement by any other user of your account, of any intellectual property or other right of anyone and the use, inability to use, unauthorised use, performance or non-performance of any Third Party Website.
  10. ANZ cannot always anticipate technical or other difficulties. These difficulties may result in loss of data, personalised settings or other interruptions to ANZ MoneyManager. Except to the extent prohibited by law, regulation or code of practice or conduct (including the ePayments Code and the Code of Banking Practice), ANZ is not liable for the timeliness, accuracy, deletion, mis-delivery or failure to store any data, communications or personalised settings. To the maximum extent permitted by applicable law, ANZ disclaims all liabilities and warranties of any kind relating to ANZ MoneyManager, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose or non-infringement.
  11. Any information and material downloaded or otherwise obtained through the use of ANZ MoneyManager is done at your own discretion and risk.
  12. ANZ reserves the right to cancel, suspend and/or modify your access to ANZ MoneyManager or any Third Party Website available through ANZ MoneyManager at any time and without prior notice. You agree that ANZ will not be liable to you or any third party for any cancellation, suspension or modification of ANZ MoneyManager.
  13. ANZ MoneyManager allows you to share your accounts with other users (each a "designated recipient"). It is your responsibility to choose with whom you will share your accounts and to set your permissions for each designated recipient carefully. Depending on the permissions you set, a designated recipient will be able to see your account information, including individual transactions, and be able to control your accounts to the same extent as you can control them through ANZ MoneyManager.
  14. You share your accounts with designated recipients at your own discretion and risk.
  15. You indemnify and hold ANZ and the service provider harmless from any loss, cost, liability, harm or consequence of any kind that is suffered or incurred by ANZ or the service provider as a result of you sharing your account information in any manner with a designated recipient.
  16. It is your responsibility to enter all of your information accurately. You will prompted to create, enter, and share a secret (known as a "shared secret") to establish a relationship between your account and a designated recipient. The shared secret is a value to ensure that only the intended designated recipient can complete the sharing process to have access to your accounts. You are required to share your shared secret with your designated recipient offline. As the 'owner' of the account, you can establish, modify, or remove the level of access to your account by designated recipients at any time.
  17. If you are a designated recipient, you will be required to enter the shared secret during the final step of the sharing process and must take the same cautions with the shared account as you do your own accounts.
  18. If you are a designated recipient you indemnify and hold ANZ and the service provider harmless from any loss, cost, liability, harm or consequence of any kind that is suffered or incurred by ANZ or the service provider as a result of sharing an account owner's account information.
  19. ANZ may collect your information (including, without limitation, information from third parties such as other financial institutions) to provide information about a product or service; to consider your request for a product or service; to provide you with a product or service; to tell you about other products or services; to assist in arrangements with other organisations (such as loyalty partners) in relation to the promotion and provision of a product or service; to perform administrative and operational tasks (including for ANZ staff training and market or customer satisfaction research); to prevent or investigate any fraud or crime (or a suspected fraud or crime); and as required by relevant laws, regulations, codes and external payment systems.
  20. If you do not provide some or all of the information requested, ANZ may be unable to provide you with ANZ MoneyManager.
  21. Your personal information will be collected and securely held by the service provider.
  22. ANZ may provide your information to another member of the ANZ Group; any outsourced service provider to ANZ; an alliance partner for the purpose of promoting or using its products or services (and any of its outsourced service providers); regulatory bodies, government agencies, law enforcement bodies and courts; other parties ANZ is authorised or required by law to disclose information to; participants in the payments system (including payment organisations and merchants) and other financial institutions (such as banks).
  23. Where you do not want ANZ or ANZ's alliance partners to tell you about their products or services, you may withdraw your consent by calling 13 13 14 (for Australian residents) or 0800 269 296 (for New Zealand residents).
  24. ANZ (or the service provider) may use, sell, license, distribute and disclose to third parties aggregated information obtained in relation to ANZ MoneyManager. Aggregated information may contain non-personal account information or data, but it does not contain personal information that could be used to identify you. Examples of aggregated information might include the number of people who use aggregation and the type and numbers of accounts that are aggregated.
  25. Subject to any applicable laws, you may access your personal information by calling 13 13 14 (for Australian residents) or 0800 269 296 (for New Zealand residents) or if you are calling from overseas +61 3 9683 9999, you may also request that it be corrected. ANZ may charge you a reasonable fee for access.
  26. If you can show that information about you is not accurate, complete and up to date, ANZ must take reasonable steps to ensure it is accurate, complete and up to date.
  27. ANZ will not collect sensitive information about you, such as health information, without your consent.
  28. If you have a complaint, call ANZ on 1800 805 154 (for Australian residents) or 0800 560 555 for (New Zealand residents). (Australian residents who are hearing or speech impaired can utilise the TTY (telephone typewriter) service by calling 1300 366 255).
  29. If ANZ is unable to resolve your complaint promptly, ANZ's specialist complaints team, ANZ Customer Response Centre (for Australian residents) or Customer Feedback Line (for New Zealand residents) will work with you to fix the matter.
  30. If your complaint is not resolved to your satisfaction, you can ask to have it reviewed by ANZ's Customer Advocate (for Australian residents) or Customer Relations (for New Zealand residents) who will provide a free review of more difficult complaints.

  31. If you are not satisfied with the steps taken by ANZ to resolve the complaint, or with the result of our investigation, you may wish to contact an alternative dispute resolution scheme.

  32. In these Terms, ANZ means Australia and New Zealand Banking Group Limited ABN 11 005 357 522 and ANZ Bank New Zealand Limited.
